Terms of Service

1. Acceptance of These Terms

PixGenia is an online suite of AI image tools operated from France ("PixGenia", "we", "us"); the publisher is identified in our Legal Notice. By accessing or using PixGenia.com (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Service.

You must be legally capable of entering into these terms under the laws of your country of residence. If you use the Service on behalf of an organization, you represent that you are authorized to accept these terms for that organization.

2. The Service

PixGenia lets you generate and edit images using artificial intelligence. The free tools (image generator, background remover, photo editor, logo maker, image upscaler, and the free Portrait Pro previews) require no account and no registration.

Two paid products exist, both described in our Sales Terms: monthly image plans, which are recurring subscriptions lifting the free daily limit (section 8 below), and the Portrait Pro pack, which is a one-off purchase (section 9 below). Taking out a plan creates an account; the Portrait Pro pack does not require one.

Without a plan, each visitor may generate up to 4 images within any rolling 24-hour period across the free AI tools (image generator, photo editor, logo maker and Portrait Pro previews; the background remover and the image upscaler run in your browser and are not counted). A separate limit also applies to all visitors sharing the same network (IP address), so that clearing cookies does not reset the quota. This quota is tracked using an anonymous identifier stored in a browser cookie, as described in our Privacy Policy. Attempting to circumvent the quota (for example by automated means or systematic cookie manipulation) is a violation of these terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Content Policy, which forms part of these terms. You must not use the Service to generate content that is illegal, that harms others, or that falls into the prohibited categories described in the Content Policy.

You must not attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its underlying infrastructure, and you must not use automated tools (bots, scripts, scrapers) to access the Service or to generate images at scale.

4. Generated Images and Responsibility

To the extent permitted by applicable law, we claim no ownership over the images you generate, and you may use them for personal or commercial purposes, subject to these terms and applicable law. Note that the legal status of AI-generated works varies by jurisdiction, and we make no guarantee that generated images are protectable or free of third-party rights.

You are solely responsible for how you use generated images, including compliance with laws on intellectual property, publicity, defamation, and consumer protection in your jurisdiction.

5. No Warranty

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, or non-infringement.

AI-generated images may be inaccurate, unexpected, or unsuitable for your purposes. We do not guarantee that any particular prompt will produce a result, that the Service will be uninterrupted or error-free, or that generated images will meet your expectations.

6. Changes to the Service and These Terms

We may modify, suspend, limit, or discontinue all or part of the free tools at any time, including changing the daily image quota, without notice or liability. Paid orders already placed are not affected: a Portrait Pro pack that has been paid for will be delivered or refunded as set out in section 9 and the Sales Terms, and a plan already paid for keeps its daily allowance until the end of the period paid.

We may update these Terms of Service from time to time. The date at the top of this page indicates when the terms were last revised. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

7. Limitation of Liability and Governing Law

To the maximum extent permitted by applicable law, PixGenia shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Nothing in these terms excludes liability that cannot be excluded under applicable law, including mandatory consumer protections in your country of residence.

These terms are governed by the laws of France. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of France, without prejudice to mandatory jurisdiction rules that may apply to consumers.

8. Image Plans (Paid Product)

The Premium subscription lifts the free daily limit: 50 images per day, monthly (€9.99 per month) or yearly (€79.99 per year), all prices including VAT. Starter and Pro subscribers who signed up before 13 October 2026 keep their plan and its limit. The allowance is a single limit shared by every tool, measured over a rolling 24-hour period, and it does not carry over from one day to the next. High-quality generation is included and counts as two images against the allowance.

A plan is a subscription: it renews automatically at each term (every month or every year, depending on the plan) until you cancel, and your card is charged the then-current price. There is no commitment beyond the current period.

You may change plan or cancel at any time, on your own, from your account page, which opens the Stripe billing portal. Cancelling takes effect at the end of the period already paid for, and you keep full access until then. The full Sales Terms (renewal, withdrawal, refunds, price changes) form part of these terms and apply to every plan.

Taking out a plan creates an account from the e-mail address used at payment, so that your allowance and your creations follow you across devices. The account is personal and a plan may not be shared. We do not guarantee that any particular image can be produced: AI generation is probabilistic and our content filters may refuse a request. A refused request does not count against your allowance.

9. Portrait Pro (Paid Product)

Portrait Pro turns 2 to 4 selfies you upload into AI-generated professional portraits. Two low-resolution, watermarked previews are free (they count toward the daily quota). The "Pro pack" — 20 portraits at 1024 × 1536 pixels, without watermark — is sold for a single payment of €24.90, all taxes included, through our payment processor Stripe. The full Sales Terms (delivery, withdrawal, refunds) form part of these terms and apply to every purchase.

You must be at least 18 years old to use Portrait Pro. By uploading photos you warrant that they show your own face, or that you hold the written permission of the person shown to have their likeness processed and portraits generated from it. You may not upload photos of minors, of public figures, or of anyone who has not given that permission. If you believe your likeness was used without your consent, write to support@pixgenia.com with the subject line "Takedown"; we remove the related order and its images promptly.

Digital delivery is immediate: the pack is generated within minutes of payment and made available on a private download page and by e-mail link, both valid for 30 days. Because delivery starts immediately with your express agreement, you acknowledge during checkout that you waive your statutory right of withdrawal (French Consumer Code, article L221-28 13°). As a commercial gesture, we nevertheless refund the full price on request within 14 days of purchase if you have not downloaded any portrait. Once a portrait has been downloaded, the pack is deemed delivered and no refund is due, except where we failed to deliver it or the delivered pack is materially defective.

The portraits are AI-generated images. They are delivered with an "AI-generated image" label and keep their C2PA content credentials; you agree not to present them as unedited photographs where that would mislead, and to comply with any disclosure obligations that apply to you. Sections 4 and 5 (generated images and responsibility, no warranty) apply to Portrait Pro, with the qualification that a paid pack that is not delivered, or delivered with fewer than 16 usable portraits, is refunded in full.
