DMCA & Intellectual Property Policy

1. Our Commitment

PixGenia respects intellectual property rights and expects users of the Service to do the same. Although generated images are delivered directly to the visitor's browser and are not hosted in a public gallery on our servers, we take reports of infringement seriously and respond to valid notices submitted under the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws, including the French Code de la propriété intellectuelle.

2. How to Report Infringement

If you believe that content created with or displayed on PixGenia infringes a copyright or other intellectual property right that you own or represent, send a written notice to legal@pixgenia.com with the subject line "IP Notice".

We review complete notices promptly and will take appropriate action, which may include removing or disabling access to the material in question and restricting the responsible visitor's access to the Service.

3. Required Elements of a Notice

For your notice to be actionable, it must include: (a) identification of the copyrighted work you claim has been infringed; (b) identification of the allegedly infringing material and information reasonably sufficient for us to locate it (for example a URL, a screenshot, and the approximate date and time); (c) your name, postal address, email address, and, where available, telephone number; (d) a statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorized to act on the rights holder's behalf; and (f) your physical or electronic signature.

Incomplete notices may be rejected or may delay our response. Knowingly misrepresenting that material is infringing can expose you to liability for damages under Section 512(f) of the DMCA and equivalent provisions elsewhere.

4. Counter-Notices

If material you created was removed or disabled following an infringement notice and you believe this was a mistake or misidentification, you may submit a counter-notice to legal@pixgenia.com.

A counter-notice must include: (a) identification of the material that was removed and its location before removal; (b) a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; (c) your name, postal address, and email address; (d) a statement that you consent to the jurisdiction of the competent courts for your address (or, for the purposes of the DMCA, of a U.S. federal district court where applicable) and that you will accept service of process from the person who filed the original notice; and (e) your physical or electronic signature.

Upon receiving a valid counter-notice, we may restore the material unless the original complainant informs us that they have initiated legal proceedings.

5. Repeat Infringers

We reserve the right to restrict or terminate access to the Service for visitors who are the subject of repeated valid infringement notices, to the extent that our anonymous, account-free design permits identification of a recurring visitor.
